Participants in the Sweepstakes agree that they have read, understood and accepted these Official Rules and agree to be bound by them, including all eligibility requirements and decisions of the Sponsor. We recommend that you print out and keep a copy of the Official Rules for future reference.
1. Agreement to Rules
By participating, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Day Online Solutions, LLC (the "Sponsor") as final and binding as it relates to the content.
2. Eligibility
The Sweepstakes is open to residents from the United States, Australia, Canada (excluding Quebec), and United Kingdom that are 13 years of age and older as of September 11th, 2017. Employees and moderators of the Sponsor and their respective affiliates, advertising and promotion agencies, suppliers and members of their immediate families are not eligible to enter or win. Any entry by such persons will be deemed invalid. No entry may be made on behalf of third parties. If any winner is deemed a minor in the jurisdiction of his/her residence, the winner will need parental consent in order enter the Sweepstakes and to be awarded the Prize or the Prize may be awarded to his/her parent/legal guardian (as determined by Sponsor in its sole discretion). The Sponsor reserves the right to request proof of age or identity. Winner(s) may be required to sign an Affidavit of Eligibility and Liability/Publicity Release (the "Documents") as a condition to the delivery of the applicable prize, for prizes with an ARV (as defined in the Prize section) of $600+. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
3. Entry Period
The Sweepstakes starts Monday, September 11th, 2017 12:00am and ends Monday, September 11th, 2017 11:59pm. All references to dates and time shall be based on Eastern Time ("ET"). Sponsor's computer is the official time-keeping device for the Sweepstakes. The Sponsor reserves the right to make changes to the Sweepstakes schedule at any time.
4. How to Enter
You may only enter once in this Sweepstakes. There are two ways to enter the Sweepstakes during the Entry Period, the "Online Method" and the "Alternate Method". The Online Method is only available for eligible persons (as defined in the Eligibility section) with a registered account at instaGC.com. To enter using the Online Method visit instaGC.com/sweepstakes/free-daily-sweeps-33391 (the "URL"). Click the Enter button and confirm the prompt. To enter using the Alternate Method, you may mail in your entry. On a 3" x 5" piece of paper or postcard, hand-print your first and last name, mailing address, email address (if available), phone number (if available), and mail to: Day Online Solutions, LLC; Free Daily Sweeps - #33391; PO Box 48; Sellersburg, IN 47172-0048. Limit one entry per envelope. If an Alternate Method entry is received after the Sweepstakes has ended, the entry will be placed in a similar Sweepstakes.
5. Random Drawing
The winner of the Sweepstakes will be selected in a random computer-processed drawing from among eligible entries. Winners who entered through the Online Method will have their username(s) posted at the URL and will be notified via email within 5 minutes following the drawing. Winners who entered through the Alternate Method will have their initials posted at the URL and will be notified in the following order: email, telephone, or mail within 5 days following the drawing. The Sponsor shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted or is ineligible, prize may be forfeited and an alternate winner selected. The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations.
6. Prizes
One (1) Grand Prize: 50 points. One (1) Second Prize: 45 points. One (1) Third Prize: 40 points. One (1) Fourth Prize: 35 points. One (1) Fifth Prize: 30 points. One (1) Sixth Prize: 25 points. One (1) Seventh Prize: 20 points. One (1) Eighth Prize: 15 points. One (1) Ninth Prize: 10 points. One (1) Tenth Prize: 5 points. Total approximate retail value ("ARV") of all prizes is $2.75 USD. No substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute a prize of equal or greater value. Prize will be automatically added to the account(s) of winner(s) who enter via the Online Method or the Alternate Method. If the winner does not have or is unable to create an account at instaGC.com, prize will be sent in a mutually agreed-upon manner.
7. General Rules
All taxes and fees resulting from acceptance of prize are the responsibility of winner. By entering the Sweepstakes, Entrant (or Entrant's parent/legal guardian if any Entrant is deemed a minor in the state/province or country of his/her residence) accepts and agrees to these Official Rules and the decisions of Sponsor, which shall be final in all matters. By accepting the prize, the winner (or winner's parent/legal guardian if any winner is deemed a minor in the state/province or country of his/her residence) agrees to hold Sponsor, its affiliates, directors, officers, employees and assigns harmless against any and all claims and liability arising out of use or redemption of prize. Acceptance also constitutes permission to the Sponsor to use the winner's name, likeness, and biographical data for marketing and publicity purposes without further compensation or right of approval, unless prohibited by law. Sponsor is not responsible for lost or late mail, or for technical, hardware or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any human error which may occur in the processing of the entries in this Sweepstakes. The Sponsor gives no assurance and no promises that the instaGC.com website (or any of the services connected with the Sweepstakes) shall be free from errors or omission nor that they will be available uninterrupted and in a fully operating condition. If, in the Sponsor's opinion, there is any suspected evidence of tampering with any portion of the promotion, or if technical difficulties compromise the integrity of the promotion, the Sponsor reserves the right to modify or terminate the Sweepstakes in a manner deemed reasonable by the Sponsor, at the Sponsor's sole discretion. In the event a dispute arises as to the identity of a potentially winning online entrant, entries made by Internet will be declared made by the name on the online entry form. Potential winner may be required to show verifiable proof of identity. All federal and state laws apply.
8. Special Rules for Canada Residents
Selected winners will be provided with a time-limited, multi-step and multi-operational mathematical skill testing question, that must be correctly answered without assistance. The question will be provided on the claim prize page. If question is incorrectly answered, as determined by Sponsor, selected winner will be disqualified, and an alternate winner will be chosen.
9. Special Rules for United Kingdom Residents
Provisions of the Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement. Any dispute arising in connection with this Sweepstakes may be heard in the courts in their place of residence (being either the courts of England and Wales, the courts of Scotland or the courts of Northern Ireland). This provision does not affect the Entrant's other statutory rights as a consumer. For further information about statutory rights contact your local authority Trading Standards Department or Citizens' Advice Bureau. This provision shall replace the second sentence of the Disputes section. For the avoidance of doubt, to the extent that English law applies, nothing in these rules shall limit or exclude either party's liability for fraud or for death or personal injury caused by its negligence, or any other liability to the extent that it cannot be excluded or limited by law.
10. Disputes; Governing Law
Except where prohibited, the entrant agrees that any and all disputes, claims and causes of actions arising out of or connected with the Sweepstakes or any prize shall be resolved on an individual basis without resort to any form of class action. Any and all disputes, claims and causes of actions shall be resolved exclusively by the United States District Court for the Southern District of Indiana, or the appropriate Indiana State Court located in New Albany, Indiana. Any issues or questions of construction, interpretation, validity, or enforceability of these rules, or the rights and obligations of the entrant and/or Sponsor in connection with the Sweepstakes shall be governed by, construed and interpreted in accordance with the laws of the State of Indiana, without giving effect to any choice of law or conflict of law rule which would cause the application of the laws of any jurisdiction other than the State of Indiana. Any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees. Entrant (or Entrant's parent/legal guardian if any Entrant is deemed a minor in the state or country of his/her residence) hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
11. Severability
If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
12. Odds of Winning
The odds of winning will depend upon the number of eligible entries received.
